Understanding Aggravated Speeding Charges
The difference between speeding and aggravated speeding is measured in miles per hour. When you are accused of driving more than 25 miles per hour above the speed limit, what would normally be charged as a petty offense becomes a Class B misdemeanor, punishable by a possible $1,500 fine and no more than six months in jail. If you are accused of exceeding the speed limit by 35 miles per hour or more, the crime is prosecuted more harshly as a Class A misdemeanor, with the potential for a year of jail time and a $2,500 fine.
Aggravated speeding is considered a misdemeanor rather than a felony offense. However, an aggravated speeding charge may also come with another charge such as reckless driving, which could be charged as a felony in certain circumstances.

For a second offense, the usual jail time and fines associated with misdemeanors are imposed, but you will also have to perform 100 hours of community service. For a third conviction of driving without a license, you will have to serve a minimum of 30 days in county jail or perform 300 hours of community service.
